No Icee, AB5 likely means the end of strip clubs as we have known them. These suits to get employee status have dogged them for 40 years. But now with Dynamex and AB5, finally they cannot let the dancers be contractors. And their highest corporate executives have insisted that they cannot function with dancers being employees. They need the level of detachment and deniability.
So:
Membership Club / Private Party, so they are just Members or Party Guests, same as the men.
But the big corporations will not be able to do this. We, the little guys, have to do it.

I have read some of this and strongly disagree with the author.
But I also know that this is some of the thinking which is behind Newsom and his Care Courts Psychiatric Police State.
Now Thomas Insel says that nationwide there are 47,000 suicides annually, over 3x the firearm killings annually. And that is a huge number. But there are other ways of interpreting this besides mental illness.
This Darrel Steinberg, Mayor of Sacramento is also big player in this. Insel and Steinberg both wanting to get around ACLU opposition and change laws to get more conservatorships.
Shellenberger also wants all of this too, but he also wants to crack down on the homeless more.
I see how Newsom is able to stand in the middle of this and make himself look like a liberal, where as Newsom the rest of them are all totalitarians, as also are Susan Eggman and Tom Umberg and Richard Bloom.
Shellenberger is just a loud mouthed idiot. He wants to define the unhoused as criminal deviants and crack down on them. So it sound like SF Mayor Frank Jordan's Matrix Program, Police writing citations for sleeping. But Shellenberger wants to couch it as for the good of the unhoused, so it is about mental health.
Shellenberger got 4% of the primary vote.
What I find more dangerous are Newsom, Insel, Steinberg, Eggman, Umberg, and Bloom. They are trying to set up a mental health dystopia, as if we were not already living in that.

They have to get minimum wage plus employer's contribution to Social Security.
But this is not what is going to break the industry. Strippers already take in a lot of money. It could be reorganized some so that it works out to be within the new law.
But with these Suits and then AB5, you have to make them employees. Not because of money, but because of other legal entanglements with that, strip clubs will not be able to function.
So we have to get out from under this and go to the Membership Club / Private Party Model.

^ The issue varies from state to state, but in CA labor law is quite progressive and other states have been following CA.
If the employer cannot prove that the worker was indeed a contractor, then they will be retroactively classified as employees.
But we get out of this with the Membership Club / Private Party Model, then the women are not employees or contractors, they are just Members or Party Guests, same as the men. But we have to have our legal ducks in order to make this hold.

Strip club management says no. They need to have dancers as contractors as they always have been.
AB5 and the Dynamech decision are based on contractor work where the workers get very little. Strip clubs are not this way.

These kinds of law suits started against MBOT San Francisco in the early 80's.
It is not just back pay it is social security contributions. The upshot is that dancers have to be employees, and strip clubs cannot operate like that.
Usually it is former dancers, retired dancers, pursuing the law suits.
Need to go to the Private Party / Membership CLub model.
