Joe, I don't believe State liquor license requirements would allow free liquor give away. The Follies workaround seemed to be an attempt to meet a food to alchohol sales edict....different than trying to give away instead of selling alchohol. The code Doc quoted would prohibit the BYOB model anyways.
At least that's how I interpret all this stuff....

Thanks for the code references Doc. Seems like an attorney could get any charges dismissed not only on the lack of sign but on a patron’s activity/behavior being reasonable based on the establishment selling them the drink. This looks like the City was trying to cutoff the byob model… but I think they’ve messed up trying to ticket patrons. Also, an arrest/citation can’t be legally issued for previous act an informant has allegedly witnessed. An officer must have direct, first hand knowledge.

Boomer, easier said than done. The amount of revenue generated from the sale of alchohol is much higher than anyone realizes. It could never be replaced by a higher cover charge.

Desert, goldmonger is correct, the City annexed the business then wants to change the operating rules because they are inside the city limits. I think they, Oasis, has a strong defense. Unlike some other clubs that have faced similar challenges, Oasis has virtually no crime increase for the area which is the other argument that cities try to make.

Gold, not to split hairs but I don’t consider an emailed statement as “several quotes “ from their attorney. Best I can tell, Begner, didn’t comment and the author went with a previously issued statement on the topic.. I agree with most of your points but the most powerful, and I believe it supports what I was saying, is the City hasn’t faced the club in court where the facts and arguments could be heard by a judge. The City simply says something is so and expects the club to comply. Mr Bater is spot on.

Dr Evil is probably more equipped to answer but I'm guessing the club felt it had the right to continue operating during whatever appeals and other legal maneuvers it had filed. The article only cited Doraville's position on the matter.
