Interesting Judicial Decision In Canada

farmerart
An Ontario judge just issued an interesting decision. In effect, she legalized solicitation for the purposes of prostitution, brothels, and pimping. Prostitution itself has long been legal in Canada. This judge has given the Ontario government 30 days to convince her to stay the decision. Unlikely, prosecution witnesses have been described as "liars" in press reports of the trial.

If her decision stands, all current laws dealing with these matters will be voided in Ontario. The decision would probably be respected in other Canadian jurisdictions. The Ontario government would certainly appeal this ruling to the Supreme Court of Canada, a court which has proved itself reluctant to change decisions based on charter of rights challenges.

The complainants in the case were two street prostitutes and a dominatrix. Their argument was that the anti-solicitation laws made it dangerous for them to conduct their perfectly legal business; a violation of their charter guaranteed rights as Canadian citizens.

The dominatrix (who is an over-the-top character) was quoted as saying:
".....I can now go and spank some ass - Legally !!".

steve229; troop; et al: Rancho farmerart discriminates and accepts only female guests. Age discrimination is also applied (18-40). In addition, there is also a "hotness" factor that must be satisfied by all potential guests. The decision of the general manager of Rancho farmerart will be final on whether the potential guest has the required "hotness".

"In effect, she legalized solicitation for the purposes of prostitution, brothels, and pimping."

I heard about this ruling as well yesterday. My understanding has always been that prostitution was basically tolerated by the authorities in Canada. They did have some restrictions though that were enforced haphazardly at best...like that prostitution must be done in private places, but not in a brothel or "bawdy house". Solicitation in public places was illegal, and pimping was illegal.

I've heard of the solicitation restrictions being enforced sometimes in Ontario & the midwestern portions of Canada but rarely in Quebec. Also, there are several FS strip clubs in rural Quebec that basically operate openly as brothels, and the provincial authorities merely inspect them routinely for potential health & safety violations.

There is much hypocrisy in Canada still over the whole prostitution question. "Massage" parlours are on practically every street corner in large cities, small cities, towns, and even truck stops. The local governments treat these establishments as cash cows by requiring "therapists" to buy licences to ply their trade. I have heard fees of up to $750/yr. being levied. Edmonton, a city I know well, has upwards of 50 "massage" parlours with probably 20-30 different girls working in each one. Do the arithmetic. Similarly, escorts are charged exorbitant fees to work in each city. The fees these girls are charged far exceed the business taxes collected from small businesses with similar employee numbers. My local business taxes in Calgary never approached the numbers paid by the girls in one parlour.

That's one of the things that AMPs down in the States get busted for as well...having girls that give massages without a licence.
