The Constituion is completely silent on the issue of whetrher or not states can leave the union and as such leaving is a right retained by the State. The Constitution doesn't list any sort of procedure for states to secede, so there is no legal basis for it. In 1869, the Supreme Court ruled it unconstitutional though.
