Trump civil fraud penalty is thrown out

The title says it all. The outrageously blatant abuse of the NY court system to try to strip Trump of his company, over what was little more than a speeding ticket violation with no victim to speak of, stank so bad that even the liberal NY appeals court couldn't let it stand.
.
Next up will inevitably be the ridiculous NY criminal case.

Unless someone had Trump's financial resources, they would had pled a deal. This is a serious problem when one party has unlimited money to spend (AG) on a defendant. This judge needs to be removed for this dangerous overreach with the Judicial System. And, Trump needs his $500M back with interest on NYS Taxpayers, and Taxpayers can decide if they want AG James in office at election time.

The Judge was a Biden supporter and financial contributor. A decent human would have recused themselves, but he's a democrat.

Trump never paid the $500M because he was appealing the verdict. He did have to put up a very large bond as part of the appeal process ($175M I believe), which certainly cost him a pretty penny.

It is rare for a New York court to get something right, but even they could not ignore such a blatant violation of the eighth amendment. The entire verdict and sentence was partisan fuckery, but even the sole Republican on the NY court (essentially a centrist democrat) noted the case should never have been allowed to be brought.

Entering and James should each be disbarred and charged with election interference.

Judge Engoron's behavior is the scariest part about this. Judges are supposed to be our safeguard against overzealous prosecutors, but not this guy. Not only did he actively remove the guardrails, but he blatantly helped James carry the ball over the goal line.
.
How he is still sitting on the bench to this very day is a mystery to me.

I ran in to a buddy the morning after the Mueller report came out. Aside from his chronic TDS, he seems normal.
I asked him “how you doing?”
He said, in a depressed way, “How do you think I’m doing?”
I said, “I don’t know.”
He said, “The Mueller report said there was no Trump/Russian collusion, so terrible.” He was serious.
I laughed like he was joking and changed the subject. Pitiful.

Right. The Rainbow Coalition that is the NY Appellate First Division decided that it was white rich privilege day in NY. That includes the Presiding Justice, who is a black woman. 😉

If the "title says it all" why the need for a discussion about it? It clearly does NOT say it all. BTW, the punishment was altered, not the findings. He's still an adjudicated, civilly liable rapist, and a jury found him guilty of 34 felonies WRT the case you mentioned in the title.

The smart money would bet that the Appeals Court decision to throw out the ridiculous financial penalty would only be about 50% decided on the basis of a violation of the 8th Amendment. The real and potential consequences of businesses leaving New York and financial players deciding that the risk/benefit of doing business in a city which will attempt to bankrupt you and steal your homes and businesses in retaliation for political opposition heavily influenced their decision-making.

And, for the millionth time, Trump was never convicted of rape (which is a crime and no civil liability for it exists). Any statement to the contrary is factually false.

Stupid is contagious, don’t give up your day job as an orderly, because you ain’t qualified to be a lawyer!!
And of course you can be guilty of a crime and convicted for civil violations for the same actions.
What a dope, talking about things you have less than zero knowledge about.

I never said he was convicted of rape, what my post was doing was correcting some Internet bozo, who thinks he’s a lawyer, who said you can’t be convicted civilly if your convicted of a criminal offense

25iq is so sensitive and thin skinned, he thinks everything is about him. He is so lonely and bitter, he has deluded himself into thinking he's the main character.

How's that retirement following me around TUSCL all day?

@gammy
If I'm so sensitive and thin skinned as you say, how come I respond to your trolling me incessantly, instead of just blocking you like the vast majority of TUSCLers.
You son are the epitome of a troll, nothing you have ever said about me or any of the other targets of your pitiful insults, has ever been even remotely correct, but you keep on projecting as you like. Factually everything you say about me and all of the rest of the folks you have feuds going with, is in reality, just you assuming that everyone is like you! The reality is none of us here are anything like you, thank goodness.

A rape is a sexual assault and battery and under common law is a tort and can be the subject of a civil suit. No different than murder, which is called wrongful death on the civil side, with OJ Simpson the standard bearer. Even when I was in Law School the "Bronx Jury" was famous, so it's been well over 40 years since anything a New York Court does is something fair as far as I am concerned.
In case anyone cares I had a birdie and 12 pars Sunday and somehow failed once again to break 80.

@skibum yes and no. What you wrote is correct. However, as you know, Trump was never convicted of rape. That's a fact. Everyone knows it, even the liberals who refuse to admit. A hopelessly biased NY jury found Trump liable for sexual assault and defamation, but specifically DID NOT FIND HIM LIABLE FOR RAPE. The verdict from the jury specifically read that he was NOT found liable for rape. Therefore, anyone calling him a rapist is a dumbass, partisan, liberal who should have both their right to vote and right to reproduce revoked.
