30 years after "Nevermind", naked baby sues

Part of the complaint is about his name being forever connected to the "sexual exploitation" experienced as a minor. Problem is there was no sexual act / exploitation, and nobody would know it was this guy if he didn't sue saying it was him.


Sidenote: be careful with what you put online. Some states' statutes (like AZ as originally written) criminalize your Facebook pictures of your grandkid in the tub.

What is or isn't a sexual act can legally be taken as something that gets a person off sexually.

Per California law, the only way this album cover qualifies is if they prove the naked baby was used for the cover for "the purpose of" sexual stimulation of the viewer.


Cobain was artsy. They can't prove the intent required by statute. But chances are his estate + Dave + Krist settle and pay the guy off with a million.

They're looking at commercial exploitation. They knowingly profited off the image without permission. The lack of permission shows they were aware of the potential problems involved. Yet chose to exploit the image nonetheless.

I'm not following this issue much but I did hear on the news today that until recently spencer seemed proud of and relished his past regarding that pic.
Suddenly he's a victim and wants a payoff. I suppose his attorney didn't have any ambulances to chase the day he took that case.

Turns out the guy celebrated the 25th anniversary by trying to recreate the album cover naked, but the photographer suggested he wear shorts. And he has NEVERMIND tattooed on his chest. Fuck this money grab. His parents were paid....he should sue them. At four months old, he could not have been party to a contract anyway.
