Is It Legal If She Doesn’t Ask For Money?

I’ve got a CF that Ive known for almost a year now. After we’d known each other for a while she randomly starts giving me a combination HJ/BJ during a dance. Never asked for money before or after. Never asked if I wanted it. (Not that I would refuse). When we finished I gave her a good tip for a job well done and was on my way. Since then it’s become a regular thing along with some DATY on occasion. Not that it matters to me one way or the other but since money for services was never discussed up front would it still be considered prostitution or consensual sex? I suppose you could argue that on the second,third time etc it was implied since she knows I’ll tip extra but I’m thinking silence is golden since services and prices have never been discussed? Thoughts?

Imagine yourself making this argument in front of a judge, and guess how that would turn out.

Particularly inside of a strip club, if there's an exchange of money for rented sexy time and during that time anything illicit happens, then there's a good chance that you've broken the law.

To answer your questions; it doesn’t matter, if the police wants to frame you or arrest it doesn’t really matters.

In most places paying for an escort is legal and ‘'what two adults do on a “date” is their own business.”, technically you are paying fo a dance/companionship. So it is not illegal to have consensual sex.

In any case if you ever have to deal with LEO; first is ask if you are under arrest or detained. If not, say good night and walk away, I they say yes you are under arrest or detained for investigation, they will have to read you the Miranda Rights.

Your answer at this point, no matter the questions should be “I don’t recall and I need to talk to my lawyer”. Chances are you will be able to walk away whith not even a citation.

Most people end up in jail or in a trial, because they don’t know how to keep their mouth shut.

In her mind she's not providing prostitution. You're paying for the dance and she's providing the extras because she wants to.

The legality doesn't matter because as far as LE knows you got a routine lap dance.

I expect - if LE raids the club and picks you up in the raid - they will have difficulty in prosecuting you unless you were engaged in a sexual act (and the officer witnessed it) or if it was caught on video.

LE knows extras clubs as well as we know them. It might be a challenge for them if you remain silent and only ask for your lawyer as they move you through the process.

Its illegal. There is an inferred exchange of cash for sexual services. If it would be perceived as prostitution to the "average person"(in a legal not colloquial sense) it legally is...
