Texas Says It's OK to Shoot an Escort If She Won't Have Sex With You

A jury in Bexar County, Texas just acquitted Ezekiel Gilbert of charges that he murdered a 23-year-old Craigslist escort—agreeing that because he was attempting to retrieve the $150 he'd paid to Frago, who wouldn't have sex with him, his actions were justified.
Gilbert had admitted to shooting Lenora Ivie Frago in the neck on Christmas Eve 2009, when she accepted $150 from Gilbert and left his home without having sex with him. Frago, who was paralyzed by the shooting, died several months later.
Gilbert's defense argued that the shooting wasn't meant to kill, and that Gilbert's actions were justified, because he believed that sex was included as part of the fee. Texas law allows people "to use deadly force to recover property during a nighttime theft."
The 30-year-old hugged his defense attorneys after the "not guilty" verdict was read by the judge. If convicted, he could have faced life in prison. He thanked God, his lawyers, and the jury for being able to "see what wasn't the truth."

The acquittal doesn't say it's okay to kill a dash-and-cash. What shadowcat omits is that Frago didn't do anything she contracted to do. Didn't strip. Attempted cash-and-dash less than 1/3 into the contracted time to "give the money to her driver" Gilbert fired from a distance into the moving car. Got her in the neck. Could't have been intended, nobody is that good. She lived on life support another seven months. He spent four years in mental hospitals. Clearly a bit nuts.
Not an open and shut case.
Acquittal does not equal Texas supporting killing prostitute dash-and-cash. Not, to quote Seinfeld, that there's anything wrong with that.
Also, he used an assault rifle capable of penetrating car doors. He absolutely intended to kill to stop the escape. And yes Texans are that good; Lee Harvey Oswald, anyone?

I hate to hear this. I don't agree with not returning money if you can't at least stay for the time promised but I don't think anyone deserves to die over $150 either.

However, the thief charge is indisputable. Acting within the law, all she could do is sell her time, which she did, and she did cheat him out of 1/3rd of that 30 mins. But he also did get some service out of it.
It's unbelievable they argued theft and got away with it.
I guess on the bright side, escorts and strippers can carry guns and shoot johns over money disputes in the state of Texas; and now their attorneys have a case to site as precedence.

He was charged with murder. That requires intent and premeditation. He committed homicide. But wasn't charged with it. Can't be convicted for what he didn't do, and can't be convicted for what he wasn't charged with. Prosecute screwed up.
