Texas Says It's OK to Shoot an Escort If She Won't Have Sex With You

A jury in Bexar County, Texas just acquitted Ezekiel Gilbert of charges that he murdered a 23-year-old Craigslist escort—agreeing that because he was attempting to retrieve the $150 he'd paid to Frago, who wouldn't have sex with him, his actions were justified.

Gilbert had admitted to shooting Lenora Ivie Frago in the neck on Christmas Eve 2009, when she accepted $150 from Gilbert and left his home without having sex with him. Frago, who was paralyzed by the shooting, died several months later.

Gilbert's defense argued that the shooting wasn't meant to kill, and that Gilbert's actions were justified, because he believed that sex was included as part of the fee. Texas law allows people "to use deadly force to recover property during a nighttime theft."

The 30-year-old hugged his defense attorneys after the "not guilty" verdict was read by the judge. If convicted, he could have faced life in prison. He thanked God, his lawyers, and the jury for being able to "see what wasn't the truth."

I don't chime in often. But today shadowcat is acting like a clueless msnbc-following brain-dead leftist loser, parroting the left-wing anti-male websites as he looks under the bed for his lost vagina. Dear shadowcat, what happened to your testicles? Were you suddenly taken to the vet for a little snip?

The acquittal doesn't say it's okay to kill a dash-and-cash. What shadowcat omits is that Frago didn't do anything she contracted to do. Didn't strip. Attempted cash-and-dash less than 1/3 into the contracted time to "give the money to her driver" Gilbert fired from a distance into the moving car. Got her in the neck. Could't have been intended, nobody is that good. She lived on life support another seven months. He spent four years in mental hospitals. Clearly a bit nuts.

Not an open and shut case.

Acquittal does not equal Texas supporting killing prostitute dash-and-cash. Not, to quote Seinfeld, that there's anything wrong with that.

So, it's OK to kill a person over a $150 rip-off, you say? She stole nothing. Escorting is legal due to paying for time, not any particular service. You all should know this. Legally, he was just ripped off of some time. Either way he was ripped off of $150. But he did pay for something, just not what he wanted.

Also, he used an assault rifle capable of penetrating car doors. He absolutely intended to kill to stop the escape. And yes Texans are that good; Lee Harvey Oswald, anyone?

Thank you for posting this, cat.

That's Texas for you. I loved San Antonio when I lived there, and I found Texans very friendly. But Texans--especially native Texans--love their guns and give the benefit of the doubt to the shooter.

I love my guns, too! And I hate pimp's. But I love whores and hate so see one taken down and no justice brought. $150, man! Rip off or not, she did not deserve to die.

Doc, who does deserve to die? She did steal, at least $100 by time.

You must be some "doc" considering she wasn't hit by a bullet, but by a fragment, to call BS on the shooting at a tire. I am in honor of your skills. Or arrogance. Let's go with arrogance. It sounds better than stupidity.

She should have given him back his money if she had to leave early unless there was some clause in a contract he agreed to pay in full and she could break out of the deal and still keep 100 percent of the money paid. It sounds like theft to me. I agree she did not deserve to die or even get injured. Texas and other states can pass laws allowing deadly force against thieves but the backlash might be escorts demanding non refundable deposits just to agree to meet. Then hourly tips or fees expected on top. Then if an escort shows up,she could take the initial fee and then walk out. If she got shot, then it would be murder. He might be black listed from all escorts as well.

I hate to hear this. I don't agree with not returning money if you can't at least stay for the time promised but I don't think anyone deserves to die over $150 either.

Of course if it gets personal, yeah then I'm in favor of shooting thieves. I think I would prefer not to kill them though.

I like this comment left by one if the readers:

"Now that's the Libertarian dream in action: that man paid good money to rent the body of another human being in the free market, and when she didn't deliver the promised services he asserted his property rights without appealing to the tyrannical state by shooting her. Texas — the beacon of liberty!"

Shadow, did I just understand you to say that you "don't make the news"... you just repeat lies?

Apparently the vet did neuter you. Grow a pair. With fur on.

Ok, maybe he was aiming for the tires? But using an AK-47 is excessive force to shoot out a tire. It's a round that will penetrate 1/4 of aluminum and still damage the object behind it. A car door is far less thick. They called it a bullet fragment, because it would be damaged going through a car door, thus fragmented. But, the trajectory was clearly directed at the passenger, as can be seen at 1:21 of the video here:

http://www.ksat.com/news/kelvin-frago-te…

So, I'll give you the intent to kill may be debatable -- suspect, negligent -- but debatable.

More video with the interrogation:

another: https://www.youtube.com/watch?v=fLnvjW7f…

However, the thief charge is indisputable. Acting within the law, all she could do is sell her time, which she did, and she did cheat him out of 1/3rd of that 30 mins. But he also did get some service out of it.

It's unbelievable they argued theft and got away with it.

I guess on the bright side, escorts and strippers can carry guns and shoot johns over money disputes in the state of Texas; and now their attorneys have a case to site as precedence.

Mistoff not retarded, umissedaspot. You are. Mistoff knows what you don't.

He was charged with murder. That requires intent and premeditation. He committed homicide. But wasn't charged with it. Can't be convicted for what he didn't do, and can't be convicted for what he wasn't charged with. Prosecute screwed up.

You and shadow are quick to jump on a hyperbolic bandwagon. Slow down and learn to read.

@Mistoff: Yeah, I've seen that comment before. Basically, some are saying that if the prosecution had charged him with manslaughter instead of murder, it would have been a conviction.
