This is an interesting question. I think most people don't understand that the Bill of Rights isn't meant to be taken literally. What counts are the SCOTUS' interpretations of the amendments. They're nice literature but virtually meaningless in today's society. There are legal ways to get around every amendment.

1- Congress can't make laws establishing a state religion or curbing freedom of speech. ...At the same time, it doesn't promote secularism or protection from religion or religious influence over politics and society. It also doesn't define freedom of speech as such and includes the premise of loyalty oaths being legal whereby you can think whatever you want, but can legally be denied employment etc for your words and actions.... What this amendment is important for is when it comes to things like invasion of privacy, anti trust laws...

2- The state won't infringe on your right to bear arms. Under the premise that one may join a WELL REGULATED militia. The key term here is regulated and that's how the SCOTUS has interpreted the amendment over the years. Also, its viewed somewhat anachronistically. There's no need for militias to defend the US in wars now a days.

3- If there's a war, the military can take over your property and stay in your place...

4- Protection from unreasonable searches and seizures...The way to skirt around this without an arrest is for LE to ask if they may come inside, or view your car, etc. Once you allow them to, they can search anything in plain site. If they think you might be in danger or pay pose a threat, anything which you may have been able to touch is able to be searched.

5- You can't be accused of a crime without a Grand Jury investigation and can't be forced to incriminate yourself without first being advised of your rights...and protects you from illegally gathered evidence.

6- Right to a speedy and public trial...right to confront witnesses.. and to counsel when accused of a crime.

Does Icey think that someone is suddenly going to become interested in this thread if it keeps getting bumped ? It's kinda like SJG continuing to post to his threads that only he cares about.
