Supreme Court Antonin Scalia passed away today.

Too bad. He got it right about 99.3 percent of the time. About the only one ever.

    I wish he would have retired instead, but it's in the interests of justice that he's no longer a judge at any level.

    It's a sad day for his family.

    I'll save the politics for another day, exceot.to say this may impact the presidential nomination process, as "who would you nominate" is a very relevant policy question for the candidates.

    I hold no illusions that no one Obama picks will not get confirmed regardless of their qualifications because it's not about justice, but merely politics. One again conservatives will ignore their jobs and put partisan politics above governing.

    I have always said I would give conservatives the presidency and both houses of congress if we can have a liberal court. It seems in the current climate, I will need a liberal president after all. Will we have 8 justices for 5 years? I wouldn't put it past the Republicans to ensure just that.

    The conservatives better be careful what they wish for. President Sanders will not nominate left leaning middle of the road people like Obama will. Sanders will nominate Ralph Nader types.

    It's a sad day. Sad to hear of his passing. I doubt there will be a confirmation before the end of Obama's term. However, the concern is who will be the next President - as there could be a very left leaning looney toon!

    Cashman is right. For the good of the country, the GOP ought to encourage Obama to make a wise nominee. As it is right now, he could nominate Ted Nugent and the GOP would vote no because it was Obama who nominated him.

    Sanders is more idealistic than Hillary, and he would be happy to have a 4-4 court until another justice dies. At some point the SC will just have 2-3 justices unless the Republicans compromise. Trust me, the conservatives don't want to deal with anyone Sanders nominates.

    rockstar: With all due respect, because I do in general respect the way you support your opinions even though I seldom agree with them, what the F* does this mean: "I hold no illusions that no one Obama picks will not get confirmed". Could you weed out some of the negatives from this sentence so that it makes sense?

    I am saddened by Scalia's passing and wish that his replacement could be named by President Cruz next year, but I'm 90% certain that the Senate, even with 54 GOP members, will ratify Obama's choice before summer. We will *not* have an eight-member Supreme Court for 11 months!

    I just heard the presidential candidates say something last night that a SC justice hasn't been appointed in an election year in 80 years. That was what it sounded like but I'm not sure what they said. I recorded it but fell asleep watching it real quick.

    Only Kasich is calling like it is: The Senate won't probably approve any of his appointees so what's the point. Most of he others are hiding behind rhetoric and double-speak.

    The more obstructionist the Repubs are, the more they'll help the Demos to hold onto the White House and move towards winning back the Congress. This is a no-win situation for them.

    I didn't watch the GOP debate last night, so I don't know who said what, but the fact is that Reagan appointed Anthony Kennedy to the Supreme Court in early 1988, in the eighth year of his Presidency and only 28 (not 80!) years ago. As much as I would like to see a Republican president fill the vacancy next year, this fairly recent precedent tells me that Obama will get to sully the Court with yet another radical leftist like Kagan and Sotomayor.

    We know that the Republicans will try to block anyone President Obama nominates. Cruz has just made a statement that he will filibuster through the entire confirmation process. This is going to be a ridiculous farce all the way around. At this point I am totally disgusted with all of them, we need an adult in the room to take these children over his knee and give them the spanking they so deserve.
    This is the most disgusting display of partisan politics I have ever seen and I have seen a lot. Any person with a sense of decency and fairness that votes for any of these self entitled spoiled brats needs to have their head examined.
    If this is the best group of candidates that either political party can come up with we need new political parties, these guys are so weak, its pathetic. There is not a single serious person in either group.

    The more I think about it, the more I think this is the end of the SC. The Republicans will not approve anyone he appoints, and if a Republican becomes president the Democrats will exact revenge and not approve anyone THEY nominate. Then we'll have a 4-4 court until the next death. Eventually we'll have the last survivor as having the ultimate power.

    Or Obama can do recess appointment. HW Bush was the last to do that IIRC...I may be wrong.

    Scalia knew the Constitution limits the federal government in scope and authority, and he knew that the Constitution cannot change without the proper Amendment process.
    All the USSC Justices who don't know this are derelict in their responsibilities, and indeed are enemies of the very thing they are sworn to defend.

    @how: I agree 100%. The devil is in our opinions of what the Constitution means in specific cases. I think out founding fathers would be appalled that a political party would block ANY SC nominee out of hand. The Constitution says the president nominates replacement justices, and the Senate is free to vote "no", but saying they'll vote no no matter who it is? I find that childish and against the spirit of our Constitution.

    It gets more entertaining as the Republicans posture about their obstructionism. Also when the court meets, let's see when we have a 4-4 tie which will uphold the lower court's opinion in the case as any appointee of Obama's is blocked.

    YES, this. I would like less muddling in my life. President Obama should try to nominate an appropriate centrist. The church-y side of the gop should stfu and gtfo and the socialists on the left should do the same. I don't like either side of the aisle dictating THEIR beliefs on me.
