We have medical marijuana in Maryland. I was clubbing in West Va not too far from MD. The best looking dancer IMO sat down next to me at the bar and we began chatting. Fairly soon thereafter she said she wanted to go outside to smoke and asked me if I smoked. I don't. But sensing I'd lose the opportunity to get dances from her I followed her out back to the fenced off smoking area. We continued to chat while she had her cigarette. Once she finished, she pulled out a spliff and said she was going to light it up. Although we were in an enclosed area with a pretty high fence there was still a security camera focused on the area. She moved to the far end of the smoking area and proceeded to have her toke. I said something to the effect of "you can't do that out here". Her reply was she had a medical marijuana card. By that time I had learned that she lived in MD. WV does not yet have medical marijuana. My question is, could she get in trouble for blazing out in the open in a state that doesn't have medical marijuana? I'm sure she could be fired if management cares about such activities. I wonder if she could get in trouble with LE as well. Thanks for your input.
Dancer drug use seems pretty prevalent and seems many clubs look the other way - I assume if she was doing it it's bc the club doesn't crak down on it - plus marijuana is something many people have done for a long time even when medical marijuana was not legal - strip clubs are places of vices and part of the M.O. is a healthy-amount of looking-the-other-way
I find it off-putting - I dislike having to smell and breathe in that shit but strip clubs are not places of virtue - find it even more off-putting when a stripper approaches me with a joint in hand which happens at some dive clubs
I personally have never smoked anything. I've seen regular-old cigarette smoking do bad things to good people, and I don't personally care for the smell of marijuana, either. I'll be happy to never try it myself.
That said, I live in a state where it's not technically legal in any sense, though in the city where I live, possession of a small amount is only punishable by a $50 fine.
Go to the right concerts around here and you definitely get a whiff. I think they're not real diligent about enforcing that fine, particularly in certain environments. Get caught swerving around while driving or doing something else problematic and you have it on you? Yeah, they'll tack it on. But they're not going to go looking for it or trying to stop it in places where it's non-problematic.
Extras are against the rules/law at a lot of places and dancers still get away with them. Just because it's the law doesn't mean it doesn't happen, or that there's constant active enforcement. Weed is moving closer to being legal all over. I don't think a lot of cops or places are going to mind if a person uses it in a relatively private place like the smoking area of a strip club.
To answer the “legal part” of ops question. Technically speaking, “medical marijuana” is a state by state law. Marijuana use is still against Federal Law. Thus, if caught smoking such in a state that has not made it legal, then she could be charged with illegal possession. Another caveat is that “medical marijuana” is only allowed to be prescribed for defined medical problems; it cannot be used “off label” like other medications. It must also be dispensed via a licensed medical marijuana dispensary who receives product from a licensed medical marijuana cultivator who follows strict quality control, strict security, good manufacturing processes, and the ability to recall bad product.
However, most officials are not going to go searching for the user. They will simply add onto charges if the user was caught violating some other law.
