In my concealed carry class, they taught us that it's better to be judged by 12 than to be carried by 6. But I guess in Floe Rita you don't have to worry about being judged by 12.

This was not a case of 2 guys taking it outside. A group of 12 guys waited in the parking lot for this girl's brother and one friend. Then the mob followed these two guys to their car, where she was also standing. She even tried to diffuse the situation first, but the leaders of the pack kept coming in and there were several guys behind them trying to crowd in. She was right to fear for her safety. I just wish she had shot a few more of these stupid animals so that there would be a few less breeding more dumb shits.

In most other parts of Florida, she probably wouldn't have even been charged, at least once authorities got a good look at that video. She just had the added misfortune of having to save herself from a mob in Miami, which is far more left leaning and has always resented not being able to pass additional restrictions on guns. In Florida, there is a law on the books preventing any local municipalities from passing ordinances pertaining to gun control that are stricter than state laws.

The same is true in Kentucky. So Louisville periodically tries to charge someone with "creating a public nuisance" when they carry. "You're making people nervous, so we're going to arrest you." Never mind the fact that pansies and fucktards never seem to notice it's not the lawful carriers causing the problems.

In my state at least, you can't get a concealed carry permit without a day long training session which includes the proven ability to hit a target from various distances, the furthest being from 12 yards. I hit 38 of 40 but several people in my class hit 40 out of 40. And a few of them had mostly head shots. I took the safe route and shot for the chest. Not exactly a bunch of untrained amateurs who have no clue what they are doing.

Of course the odds are that I'd never get into a fight like this one. But being a strip club regular you never know. In any event if I did I would absolutely have shot them under these facts. And I would have gotten off even though my state has no stand your ground law. The video makes very clear that this was self defense. Insane that she was ever charged.

But you need to remember that in Florida you are prohibited from carrying your weapon in a bar or any establishment that derives most of its income from liquor sales so most of the time in Florida this shit happens in parking lots that have no or little security

Kentucky has a similar provision, you can't carry a loaded weapon in a place that serves alcohol by the drink.

The story in this case rested that she got the gun from her car, so no violation there.

This was an all-black club so chances are you would not run into this.

I believe it was shadow whom reported this incident when it first happened a few months ago – the name of the club is The Office and they have 3 locations – the main one is in Miami Gardens and there have been a couple of 2:00 AMers posted w.r.t. the Miami Gardens location; this location is a newer location that is in the Kendall area and has been opened about 1.5 yrs or so – the 3rd location was opened in Miami Beach about a year ago and the city closed it after a month of so of being opened – this club was too black for Miami Beach which is tourist oriented.

From what Rick said, this doesn't sound like stand your ground is even an issue here. She fulfilled her duty to retreat if possible as non-SYG jurisdictions require. They kept coming at her. Whether you're carrying legally or not has no direct bearing on whether it's legit self-defense or not. They can charge her with carrying in a bar if they want but it doesn't make it murder or manslaughter.

@ibb, she wasn't carrying it in the bar. She went to her car and took it out when she saw the mob of guys ready to make trouble.

@twentyfive: I agree with gmd - I didn't see any premeditation either, at least on her part. On the part of the mob perhaps, since they were lurking out in the parking lot waiting for these people to come out.

If she was able to get to her vehicle to retrieve a firearm she had time to get in the vehicle and drive away I am no legal expert but my self defense training was avoid if possible yes I am a responsibly armed citizen and I do train and practice regularly

P. S. I don't know all of the elements that are involved but I do know that pulling out a firearm would be my absolute last resort if for no other reason than the hassle and expense that this shooter will be dealing with for quite some time to come

The essence of Stand Your Ground is that you are not required to run away. Declining to run away when not required to do so does not constitute premeditation.

Not only that, if she had tried to drive away, assuming she could have gotten herself and her companion into the vehicle, which is by no means guaranteed based on what I see in the video, and managed to hit someone on the way out, she would have been liable for that, unlike for SYG.

Maybe but think of SYG as a gift for high priced attorneys who cost piles of cash like I said I don't know all of the elements but if you can get away you are always better off. Even if charges are dropped there will be an attorney that will be willing to file a civil suit Just use common sense it's less complicated.

twenty five, before you post anymore, you should probably watch the video. GMD is right that you don't have to run under SYG. But I highly doubt that an easy getaway was happening anyway. These guys were blocking in the cars.

PS if you don't agree that ok I always feel that it's better to avoid trouble if possible and I am aware sometimes it's just not possible just be sure that being right is more important than the consequences like I said that's just my opinion

The "consequences" were that two guys didn't get beaten badly, maybe even to death, by a mob of 12. Watch the video. The consequences were that the animal leading this band of asswipes is dead. I think I can live with those consequences. ;)

Florida also has the castle doctrine, where one can use deadly force to protect one's home during a break in. In some states, you can be sent to jail for shooting a guy who enters your home, in the dead of night, with ill intent. I've even seen cases where these fucking worms actually sue homeowners who shot them. In Florida, that same piece of shit earns himself nothing but the right to a body bag. Yet another enlightened law put in place by the good people of FL.
