Kokomo asks court to shut down strip club

City officials revoked the club's zoning status in December after the club allegedly violated the zoning ordinance, 24-Hour News 8 news partner The Kokomo Tribune reports.
The club opened right before the city passed an ordinance in 2002, which gave them the right to operate as a business despite what the ordinance says - the club cannot be located within 1,000 feet of a state highway, church or school. In order to be able to do this, they have to have a legal non-conforming status, which meant they could not expand more than 10 percent of its size.
The city says the owners violated that agreement after they expanded last year and added 19 percent more space by taking out a wall between the club and a next door photography studio.
The club owners allege the city approved the expansion. They also say the city doesn't have any proof the expansion didn't happen in more than one stage.
The owners' attorney also says the club shouldn't have to close since they have an approved liquor license even if they are ordered to stop operating as a sexual-orientated business.
The city and the club owners will meet for a court date next week.
