Erotic dancers Cassandra Malandri and Falynn Rodriguez were performing at Manhattan's "Big Daddy Lou's Hot Lap Dance Club" in 2008 when they allegedly offered an undercover police officer a "threesome."
Malandri, better known as porn star Alexia Moore, and her alleged partner in crime tried charging the cop $5,000 for the pleasure.
The New York Daily News reports that Manhattan Assistant District Attorney Daryl Reed is concerned the women may claim "that they're lesbians" as one of their defenses.
Defense lawyer Ikiesha Al-Shabazz says the prosecutor's scheme "doesn't even make sense," and the logic that lesbians don't have sex with men for money is just "faulty."
Meanwhile there's a slim chance the women may not even stand trial due to the fact that the prosecution used incorrect grammar in the charging document filed in court.
An errant "and" instead of "or" may render the whole case moot, although that is unlikely.
