If reflecting the rights and capacity means exercising judgement about the circumstances I agree. For instance a 17 year old should be able to consent to having sex with a 20 year old but a 30 year old would be messed up. Also ages may be illegal but there is a massive difference between let’s say 17 and 14z
So yes consider capacity but there still need to be limits.
