minimum age of consent to sex may be consensual in fact, if not in law.

...enforcement of criminal law should reflect the rights and capacity of
persons under 18 years of age to make decisions about engaging in consensual
sexual conduct..."

If reflecting the rights and capacity means exercising judgement about the circumstances I agree. For instance a 17 year old should be able to consent to having sex with a 20 year old but a 30 year old would be messed up. Also ages may be illegal but there is a massive difference between let’s say 17 and 14z

So yes consider capacity but there still need to be limits.
