ALBUQUERQUE (KRQE) - The Palms strip club is one step closer to opening near a very popular gym despite efforts to keep that from happening.
Monday an Albuquerque city zoning officer ruled in favor of The Palms saying the strip club complies with all city zoning laws. The club is set to open near Defined Fitness on McLeod west of San Mateo basically sharing the same parking lot.
Defined management says its day care center at the gym should be considered a school, and zoning approval for The Palms is a mistake.
The mayor's office says there's nothing in the law to prevent The Palms from getting a license to operate because it's not near a school or a church.
The Palms still has not decided if it will sell alcohol and go topless, or go all-nude, which would block them from selling booze.
The Albuquerque City Council will have the final say on whether the business should open. City leaders can decide if they want to go with the hearing officer's recommendation or face a possible lawsuit.
