In Maryland, it is a misdemeanor punishable by up to three years in prison and a $2,500 fine for persons living with HIV to knowingly transfer or attempt to transfer HIV to another person. Any type of HIV exposure, including consensual sex... may be subject to prosecution. On its face, neither disclosure nor the use of condoms or other protection would operate as an affirmative defense to prosecution under this law. https://www.hivlawandpolicy.org/states/maryland
