A: Technically the “club” (Spearmint Rhino Companies Worldwide, Inc.) is a business that has to follow the laws. However, each club location is independently owned, operated and licensed.
In my humble opinion and limited experience, the dancers are “independent contractors” and they decided if they want to “allow” touching first, and they know how to do it without getting in trouble with the management.
And of course you have to remember that "Your mileage may vary" (YMMV).
Remember, the experiences of sex workers, as well as their customers are rarely homogeneous, ranging from empowering and highly profitable to exploitative and dangerous, depending on factors like safety, and individual circumstances.
