Kylie Jenner - youngest daughter of Caitlyn Jenner - is banging some rapper named Tyga. He's 25 and she's 17. The age of consent in California is 18 and it's also illegal if one party is under 18 and the other party is more than 3 years older.

"In California, there is a crime of "Unlawful sexual intercourse", which is an act of sexual intercourse with a person under the age of 18 who is not the spouse of the person. (CA Penal Code § 261.5 (a))"

Why isn't this guy sitting in jail?

    Celebrities are above the law in California. And most other places.

    Many laws aren't enforced. In the case of older teens in consentual relationships, you'd need a zealous parent and a zealous DA. But most DA don't like cases with non cooperative victims.

    Now if she got mad at him and cried rape? Things could get messy for him.
