A man who claims he was celebrating his 28th birthday when he downed a flaming shot of rum -- burning his chin, neck and chest -- filed a $49,000 lawsuit against the Northeast Portland strip club that allegedly served him.

According to the lawsuit filed last week in Multnomah County Circuit Court, Christopher Both was visibly intoxicated in September 2013 when a friend of his asked a bartender at Jody’s Restaurant & Lounge to serve Both a flaming shot of Bacardi 151. The suit claims that the unnamed bartender set the rum on fire and gave it to Both.

The suit states that a warning label on the bottle states that the rum should not be used for flaming drinks. Both suffered burns to 4 to 5 percent of his body.

The suit seeks $2,702 in medical expenses and up to $46,298 for Both’s pain and suffering.

Owner Joseph Tanner couldn’t be reached for comment.

Jody’s Restaurant & Lounge, at 12035 N.E. Glisan St., appears to be closed. The phone was disconnected, and the business’s website is no longer working.

Sounds like the woman who tried to sue Wendy's after she spilled hot chili on herself. Never mind that she was smoking a cigarette, yapping on her cell phone, and driving, all at the same time. I guess she was laughed out of court.
