AUSTIN, Texas — A man was arrested for allegedly fatally shooting a staff member at a strip club in South Austin over the weekend.

The incident happened at 2:24 a.m. on Saturday, September 9 at the Red Rose Cabaret nightclub at 3615 South Congress Avenue.

Austin police say a caller reported a person was shot and the suspect had left the scene. Upon arrival, officers detained the suspect, Elliot García, 41, as he walked by.

Austin-Travis County EMS arrived at the scene and found the victim, Philip Foley, 40, on the ground with a gunshot wound. Foley was taken to the hospital, where he later died.

Detectives and Crime Scene Specialists responded to the scene and determined that García was in an altercation with staff members minutes before the shooting, so staff asked him to leave. García waited outside for a ride when Foley spoke to him, which agitated García. That's when investigators believe García pulled out a handgun and shot Foley.

García then fled the scene before being arrested by APD.

García was booked into the Travis County Jail for first-degree murder under a $300,000 bond.
